Terms of Service

The agreement between you and Perical for using the platform.

01Acceptance of Terms

By accessing or using Perical, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Platform. We may update these Terms from time to time; the "Last updated" date reflects the most recent version.

02Eligibility

The Platform is intended for users who are at least 18 years old. By using the Platform you confirm that you are at least 18 years of age. The Platform is not designed for children, and we do not knowingly collect personal information from children.

03Description of Perical

Perical is an event-management platform that provides tools for publishing events, selling tickets, planning and running the room, tracking attendance, checking guests in, communicating with guests, and sharing files. Event organizers use Perical to run their own events; guests use Perical to discover, RSVP and attend them.

04Accounts

You must create an account to use most features of the Platform. Account authentication is provided by a third-party authentication provider. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

You must provide accurate information when creating an account. You may delete your account at any time by submitting an account-deletion request from your Privacy settings, subject to the Platform's review workflow.

05User Responsibilities

  • keep your account credentials secure;
  • comply with these Terms and the Acceptable Use Policy;
  • comply with all applicable laws;
  • provide accurate information about yourself and, where applicable, about guests you add;
  • obtain any consents needed from guests whose information you add to an event; and
  • not interfere with the security, availability, or integrity of the Platform.

06Event / Organizer Responsibilities

Event organizers are responsible for how they use Perical to manage their events, including the accuracy of guest and event information they submit and their compliance with applicable law. Organizers are independent of Perical and are not Perical's employees or agents. When an organizer determines why guest or event information is collected for their event, and Perical processes that information to provide the service, the organizer and Perical may each have distinct roles under applicable data-protection law; this is described further in our Data Processing Addendum.

Organizer identity verification. To help prevent fraud and abuse, an organizer must verify their identity through DigiLocker (the Government of India's digital document service) before they can create or publish an event on the Platform. An event cannot be created until this verification is completed. The verification is used only to confirm the organizer's identity and eligibility to host; it does not make Perical a party to the event and does not transfer responsibility for the event away from the organizer.

07User Content

You retain ownership of content you submit to the Platform, including messages, event updates, event information, images, files, and event content. You grant Perical only the permissions necessary to operate the Platform - for example, to store, transmit, and display your content to authorized users, and to process it as described in our Privacy Policy.

You are responsible for the content you submit and represent that you have the rights to submit it. You may not submit content that violates the Acceptable Use Policy, infringes third-party rights, or is unlawful.

08Intellectual Property

The Platform, including its software, design, branding, and original content, is owned by Perical and its licensors and is protected by applicable intellectual-property laws. You may use the Platform only as described in these Terms. Nothing in these Terms grants you ownership of the Platform or its underlying technology.

09Third-Party Services

The Platform relies on third-party services for authentication, hosting, email delivery, file storage, and observability. Your use of these services is subject to their own terms and privacy practices. The Platform may also link to external websites, which are not controlled by us.

10Acceptable Use

You agree to use the Platform in accordance with our Acceptable Use Policy, which forms part of these Terms. In particular, you may not use the Platform for unlawful purposes, to harm others, to gain unauthorized access, or to interfere with the Platform or its users.

11Security and Abuse

We take reasonable measures to keep the Platform secure, and we expect the same of our users. You may not attempt to access areas of the Platform you are not authorized to access, probe or test its security controls (except for responsible, disclosed security research), introduce malware, or interfere with the Platform's operation. If you believe you have found a security vulnerability, please report it responsibly to security@perical.in rather than exploiting it.

VPNs and location-concealment services. Using a virtual private network (VPN), proxy, or any other service to conceal or change your location when accessing the Platform is strictly prohibited. We detect such use for security and abuse-prevention purposes. Where we detect the use of a VPN or similar mechanism, the associated account is automatically locked for five (5) days; the lock is lifted automatically once the five-day period ends, unless the conduct also warrants separate action under these Terms or the Acceptable Use Policy. This is described further in the Acceptable Use Policy.

12Availability

We aim to keep the Platform available, but we do not guarantee uninterrupted or error-free operation. The Platform may be temporarily unavailable for maintenance, upgrades, or reasons outside our control.

13Modifications

We may modify the Platform, its features, or these Terms from time to time. Where changes to these Terms are material, we will update the "Last updated" date and, where appropriate, notify users. Continued use of the Platform after changes take effect constitutes acceptance of the updated Terms.

14Suspension and Termination

We may suspend or terminate your access to the Platform if you violate these Terms or the Acceptable Use Policy, or where we are required to do so by law. We will generally give notice where practicable. You may stop using the Platform and delete your account at any time by submitting an account-deletion request from your Privacy settings.

15Account Deletion

When you request account deletion, your request is reviewed through the Platform's privacy workflow and, once approved, our deletion service processes the removal or anonymization of your records as described in our Privacy Policy. Some records may be retained where necessary for security, legal obligations, or audit accountability.

16Disclaimers

The Platform is provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Platform will be error-free, secure, or uninterrupted. To the extent permitted by applicable law, we disclaim all warranties to the maximum extent allowed.

17Limitation of Liability

To the maximum extent permitted by applicable law, Perical and its affiliates will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data, arising out of or related to your use of the Platform. Our total liability for any claim arising out of or related to the Platform will not exceed the amount you paid us to use the Platform in the twelve months preceding the claim, or one hundred Indian rupees (INR 100), whichever is greater.

18Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless Perical and its affiliates from claims, damages, and expenses (including reasonable legal fees) arising from your use of the Platform, your content, or your violation of these Terms or applicable law.

19Governing Law

These Terms are governed by the laws of India. The governing jurisdiction will be finalized by the operating entity and published here; until then, courts in India shall have jurisdiction over disputes arising from these Terms.

20Dispute Resolution

We hope to resolve any disagreement amicably. Before initiating formal proceedings, you agree to contact us and give us a reasonable opportunity to resolve the matter. Formal dispute resolution will be conducted in accordance with applicable Indian law.
